HomeWise Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using the HomeWise application ("HomeWise", "the App", or "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use HomeWise.

You must be at least thirteen (13) years of age to create an account and use HomeWise. If you are between 13 and 18, you represent that you have the consent of a parent or legal guardian to use the Service.

2. Description of Service

HomeWise is a household management platform designed to help individuals and households organise their daily lives. The Service includes features for shopping list management with barcode scanning, home inventory tracking with expiry date alerts, meal planning and recipe management, task management with recurring tasks, budget tracking with expense splitting, calendar event coordination, household communication, home maintenance tracking, quick nutrition scanning, and push notification reminders.

HomeWise is available as a mobile application on iOS and Android. Features may vary between platforms and may change over time.

3. Account Registration

To use HomeWise, you must create an account using a valid email address, Google Sign-In, or Apple Sign-In. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Each account is for a single individual. If you believe your account has been compromised, you must notify us immediately at privacy@thehomewise.com.

4. Subscription Terms

Free Tier — HomeWise offers a free tier with limited functionality. Free tier limits currently include a maximum of one (1) shopping list, twenty (20) inventory items, and two (2) household members. We reserve the right to modify free tier limits at any time with reasonable notice.

Premium Subscription — HomeWise Premium unlocks the full feature set without the limits of the free tier. Premium is available as a monthly or yearly auto-renewing subscription.

Free Trial — New users may be eligible for a seven (7) day free trial of HomeWise Premium. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. You may cancel the trial at any time through your Apple App Store or Google Play Store account settings at no charge.

Billing and Auto-Renewal — All subscription purchases and payments are processed through the Apple App Store or Google Play Store. Your subscription will automatically renew unless you cancel at least twenty-four (24) hours before the end of the current period.

Price Changes — We may change subscription pricing from time to time. If we increase the price, we will provide at least thirty (30) days' notice. You may cancel if you do not agree to the new price.

Cancellation and Refunds — You may cancel your subscription at any time through your app store account settings. Cancellation takes effect at the end of your current billing period. Refund requests are handled by Apple or Google in accordance with their respective refund policies. Nothing in these Terms limits your rights under the Australian Consumer Law.

5. Acceptable Use

You agree to use HomeWise in a lawful and respectful manner. You must not:

6. User Content

"User Content" means any information, data, text, or other materials that you create, upload, or store through HomeWise. You retain all ownership rights in your User Content. By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, process, display, and transmit your User Content solely for the purpose of operating the Service. This licence ends when you delete your content or account.

We do not claim ownership of your User Content. We do not access or use your User Content for advertising purposes. We reserve the right to remove content that violates these Terms.

7. Intellectual Property

HomeWise, including its design, user interface, graphics, logos, icons, and underlying software code, is owned by HomeWise and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved.

Certain data displayed within the App, including product information from the Open Food Facts database, is sourced from third-party open data providers and is subject to their respective licences.

8. Third-Party Services

HomeWise relies on third-party services to operate, including Firebase by Google, RevenueCat, and the Apple App Store and Google Play Store. We do not control these third-party services and are not responsible for their availability or practices. Your use of third-party services is subject to their respective terms.

9. Disclaimers

To the maximum extent permitted by law, HomeWise is provided on an "as is" and "as available" basis without warranties of any kind. We do not guarantee the accuracy of nutritional information obtained from barcode scans, as this data is sourced from a community-maintained database.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded by agreement.

10. Limitation of Liability

To the maximum extent permitted by applicable law: our total aggregate liability shall not exceed the subscription fees paid by you in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages. We are not liable for the actions of other household members within your HomeWise household.

11. Indemnification

You agree to indemnify and hold harmless HomeWise from any claims, liabilities, damages, losses, and expenses arising from your use of the Service, your violation of these Terms, or any User Content you create.

12. Termination

You may stop using HomeWise and delete your account at any time through the in-app account settings. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia. Nothing in these Terms excludes rights under the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law, or the Privacy Act 1988 (Cth).

14. Dispute Resolution

If a dispute arises, both parties agree to first attempt resolution through good faith negotiation. You may initiate this by contacting legal@thehomewise.com. If not resolved within thirty (30) days, either party may pursue resolution through the courts of Victoria, Australia. Nothing prevents you from lodging a complaint with the ACCC or OAIC.

15. Severability

If any provision is found invalid or unenforceable, it shall be modified to the minimum extent necessary or severed. The remaining provisions continue in full force and effect.

16. Changes to Terms

We may revise these Terms from time to time. For material changes, we will provide at least thirty (30) days' notice through an in-app notification. Your continued use after changes take effect constitutes acceptance. If you do not agree, you must stop using the Service.
